The Alpha — Terms of Use

By purchasing a membership, training package, or single class at The Alpha, you agree to the following Terms of Use.

1. Services and Payment

1.1 Training Packages
The Alpha offers training packages (1, 3, 5, 8, 10, 20 sessions). Each package has a fixed validity period clearly stated on our website prior to purchase. Unused sessions expire automatically at the end of the validity period and are neither refundable nor transferable.

1.2 Membership Payments
For fixed-term memberships (1, 3, 6, or 12 months), payments are automatically debited monthly from the customer’s chosen account on the same calendar day as the contract start. If that day does not exist in a given month (e.g., the 31st), payment will be processed on the last calendar day of the month.

1.3 Contract Renewal and Cancellation Deadlines
Memberships renew automatically for the same duration unless canceled on time:

• 1-month membership → must be canceled at least 1 calendar day before the end of the term.

• 3- and 6-month memberships → must be canceled at least 30 calendar days before the end of the term.

• 12-month memberships → must be canceled at least 30 calendar days before the end of the term.

Cancellations must be submitted in writing (email or signed letter). Messages via social media or verbally to trainers/staff are not valid. No refunds will be issued for late cancellations.

1.4 No Refund / Withdrawal After First Use
Once the first training session has been used, the right of withdrawal is voided. Refunds are not possible after the first use of a package or membership.

2. Cancellation Policy

2.1 Customer Cancellations (Long-term memberships)
Yearly memberships may only be canceled early in the following cases:

• Medical unfitness, proven with a doctor’s certificate.

• Relocation to another city, proven with official documentation.

Other reasons (e.g., loss of motivation, job changes, etc.) are not valid grounds for early termination.

2.2 Studio Cancellations
The Alpha reserves the right to terminate a membership in cases of:

• Violation of studio rules.

• Repeated non-payment.

• Disrespectful or disruptive behavior.

In such cases, the membership is terminated immediately without refund.

3. Training Terms

3.1 Booking and Cancellation of Classes
All classes must be booked in advance. Cancellations must be made at least 6 hours before the scheduled start.

• Members: late cancellations result in a €25 penalty, payable immediately.

• Non-members (class packages): the session is deducted without refund.

Repeated late cancellations (3 or more times) may lead to temporary suspension of booking rights.

3.2 Missed Sessions
The client is responsible for attending booked sessions. Missed classes are lost and non-refundable.

3.3 Non-transferability
Memberships and session packs are personal and non-transferable. Sharing access with others is prohibited.

3.4 Expiry of Sessions
Unused sessions expire at the end of the validity period. Extensions are only possible with a medical certificate confirming inability to train.

3.5 Conduct
The Alpha reserves the right to suspend or terminate access for clients displaying harassment, disrespect, or repeated violation of studio rules. In such cases, no refund will be issued.

3.6 Validity of Session Packs
Each session pack (5, 8, 10, 20 classes) has a fixed validity period. It is the client’s responsibility to monitor the expiration date and remaining credits.

4. Studio Rules

4.1 Health & Safety
By booking and attending classes, the client confirms they are physically fit for training and, if necessary, have consulted with a physician.

4.2 Liability
While we take every precaution, The Alpha is not liable for injuries, accidents, or health issues occurring during or after training. Clients are liable for damages caused to studio equipment or property.

4.3 Lost or Stolen Items
The Alpha assumes no liability for lost or stolen belongings. Lockers are provided at client’s own risk.

5. Data Privacy

All personal data is processed in line with the General Data Protection Regulation (GDPR). Data is used only for membership management and communication. Detailed privacy policies are available upon request.

6. General Terms

6.1 Governing Law
These terms are governed by Austrian law.

6.2 Updates to Terms
The Alpha may update these Terms with 30 days’ notice. Continued use of services constitutes acceptance of the new Terms.

6.3 Language
In case of discrepancies between versions, the English version is legally binding.

7. Final Provision

By purchasing a class, session pack, or membership at The Alpha, the client confirms they have read, understood, and accepted these Terms of Use.
